Right, because it happened to me as well in my C2D (Core 2 Duo) w/o v. card so, i changed my video mode from OpenGL to 3D it worked fine..
But, in my second machine its 99+ Fps all the time.

oh, so i should test to change it to 3d instead of OpenGl?

well and my machine seems to be better than the one you have?

Are you saying c2d is better than core i7?!?

But just disable the damn vsync and type fps_max 101. How hard can it be?!?

Are your video drivers installed? One of my systems is exactly the same (overclocked though) and it is capable of reaching more than 1000 fps (>1K).
