It goes against valve's server guidelines to give players items they do not own.

well for csgo they issued a statement and banned gslt tokens.
they never made a firm statement about tf2, but it seems like their response is something like..
we know people do it, but we would rather them not.. not gonna do anything until it becomes more prevelant.

isn't "tf_birthday 1" enough for party hats? https://wiki.teamfortress.com/wiki/Birthday_mode

Yes they did.

Go on, try to give players hats using TF2Items and see what happens.

...because Valve blocked attaching items to players. Twice. And made clients check if a player owns an item and makes it invisible if they don't.

There is several ways around that patch if you're willing to take it. However they are cheeky and not as great.
