There is a way to force sv_cheats 1 without hacking in TF2. Here are the steps.
  • Connect to a server.
  • Press escape.
  • Click Workshop.
  • Click Publish New Item.
  • Click Cosmetics.
  • Click on the "Item Name" bar. (this step might be optional)
  • Wait for the sv_cheats check to fire.

I have confirmed that this will set sv_cheats to 1 without a hack.

That's not really a false positive (as sv_cheats is still being/staying enabled client-side) rather than it possibly unintentionally enabling cheats.

Well if you put it that way. But smac automatically bans people with sv_cheats 1 based on the premise that it is impossible for clients to change without an actual hack, so it doesn't seem reasonable to leave these people banned or to keep this check enabled until Valve fixes it.

Indeed. It should probably only kick for that, rather than ban.

Just because it is possible doesn't make very it probable. A client would most likely only be trying to do this for nefarious reasons. This is highly more probable, than what you are saying, they "accidentally" went through this process by mistake? Yeah let's turn the check entirely off lmao. Good try?
