haha ive tried to get him to stop, his excuse is, "i quit after my last cigarette", and we drink a lot anyway

I live in new jersey and cops don't do anything about me smoking when I'm 17. I know kids that smoke when they're 13 and cops don't do anything about it. I guess there's really no legal age to smoke but there's one to buy.

In the NY/NJ area, there is no legal smoking age. The ban on selling tobacco to people under 18 years of age is national, however each state can determine their own laws on whether smoking is illegal itself.

lol here people at 14 years start smoking i think thats because from 13 years you start going to disco, from 8pm to 12pm. and on 15-16- you start going from 1am to 6-7am :S and they sell alcohol. Now i realise my country suck, i live in Argentina

I can say that my lil sis is 17 and she smokes...via I live VA, USA, and she has been caught by cops with cigs on her before and they did jack shit...I mean smoking underage is sorta misdemeanor if you ask me...not really a federal offense...so yea...

If it is a misdemeanor then it is pretty much up to the cop that stops you whether or not they want to arrest you...because I also have a good...#1 dude I trust pretty much with my life...who is younger than I and he said he got pulled over by a cop because he had a broken windshield last year when he was trying to get home...and well he got so pissed about being pulled over that he when he got out of his car pulled a cig out and just started to smoke infront of the cop and the cop obviously already saw his ID...and well the cop just gave him a ticket for the busted windshield and did nothign about the smoking...

There is no way you'd get arrested for smoking either way. It's a summons at best if it is illegal in any state.

Drinking is actually way worse than smoking tell the truth...

But nonetheless everyone has the right to think as they will...

I prefer smoking over drinking because well with drinking it is harder to do right away a lot because you wake up with hangovers with smoking you can do it and be messed up for several hours and then pass out then wake up perfectly fine...(and this goes for both types of smoking...cigs or the other thing)...
